Hello Sir,
I'm currently on OPT EAD working for Southern Company Gas as a contractor through Lancesoft Inc (staffing company) on w2.
I haven't been able to visit India in 2 years and the staffing company is filing my h1B this year. I have few questions
1. Am I allowed to continue to work on Stem opt if my H1B is not picked? The staffing company is located in Virginia and I work in Atlanta,Georgia. I'm not sure how employer -employee relationship is defined.
2. If my H1B is picked at the point of entry how will I justify myself? Sorry I'm very new to this and confused as to what to do.
I'm asking because I have a full time offer but I intend to stay in this company because the work culture and work is very good as compared to my new full time offer.
Will I be able to visit India and come back if I'm on a w2 contract?
