Hi,
I am the primary applicant on our GC and my wife got a job using EAD and the client wants her to work as independent contractor and thus client will not be withholding any taxes. Can she do so and if so, does she need to work on 1099?.

Please provide some suggestion.

Thanks,
Mohan

yes, she need to work on a 1099 basis. since she is derivative her work status (w-2 vs 1099) will not affect the GC process.

Just wanted to take the opportunity and educate myself on 1099!

How would one work on 1099. How would the company pay him/her. How would one report the income to the IRS.

I have developed a software and one company is interested in and wants to buy it. Can they pay me on this 1099.

Info to Wella

Hi Wella,
This is the info I got from few of my collegues who work on 1099.
1) If we work on 1099 and the rate they need to pay is $100/HR, Company pays you $100/HR without holding taxes.
2) Then you need to file the taxes per quarter.
3) At the endo the year when the company gives 1099, you need to file the taxes showing the proff of your pre-paid taxes and 1099.
