Working in non underserved area while pursuing NIW ( via working in underserved area)

In a job that i found the employer told me that I will be working in 3 hospitals one of them is not in underserved area, but the other two are. I need to work in underserved area to maintain my NIW application. He said the previous J1 physician was able to work in all 3 hospitals. Any suggestions. Can i work in a non underserved hospital like that while maintaining NIW application.

This is a very common practice. I know many people who get the NIW in an underserved area and work in other areas also. If you go by the book, you are safe as long as you spend your 40 hours/week in the underserved area. As long as you do that, you can do whatever you want for the remainder of your time.

If you work less than 40 hours, you are taking a chance, as you can be in trouble if you get audited. However I have known of people who work less than that, and have not had any problems.
