Sorry to post here but since this being the most active forum, expected some answers.
One of my friend never applied for GC and hence works on H1. 6 years will be completed in about 3 months and he is not interested in returning to US. The US company (which has no presence in India) is willing to have him work for them (possibly contract basis) even from India.
1. Can this be worked out?
2. What would be the tax situation since payment would be in dollars by an US co. (pay in both countries)?
3. What are the legal issues?
