Work without authorization!

Hi you all,
since my interview is coming up (April 27 th) I'm so sleep deprived already, that first of all I wanna thank everyone for there help and advice!

We've got married in July 2005 and I've overstayed my B1/B2 Visa for almost 1.5 years. I know that it should be forgiven once you get married but now I'm reading about 6 months overstays are forgiven but not more than that???

I also started working as a nanny (without the work authorization ). I got my EAD card the end of march so I havn't had the chance to really use it for my nanny job but we'll start in may making everything official.
How should I handle this situation? I never lied on the documents I had to fill out and was honest about my work situation, but I'm just scared since I overstayed and worked without authorization, that they might deny it.

Also, do you think I should take a letter from the family I'm wokring for stating when I started, hours etc.??? Any advice is appreciated ( hopefully more and better sleep follows )


My husband and me have been a couple for almost 5 years, so I'm not really worried about proving that our relationship is real.

I also was thinking of asking friends to write refrence letters about us, since they've known us and how our relationship started etc. They asked me now what the letter should look like and I hoped someone out here has experience with that!


O.k. now I got a headache and hope my questions will be answered!

I'm pretty sure that that only applies to traveling abroad. You should not travel if you have overstayed more than 180 days, because then you may be denied re-entry.

But other than that I really don't think your 1,5 years matter, as long as you stay in the US! I'm pretty sure it's forgiven.

Concerning your other question about unauthorized employment, I really don't know. I definitely wouldn't lie about it though.
I'm sure you are going to be fine, but do wait for more opinions on that.

Yeah, I'm not gonna travel til I get this beautiful plastic green card in my hand.
A friend of mine got a lawyer and she told him she was working as a nanny and he said he can't take her case because she has been working (she came here on a b1/b1 got married etc.). So that scared me, but other than that I hope everything is gonna be o.k.! :)

I'm gonna bring everything I have (tons of picture albums, life insurance, documents etc.) since my job requires that I still live with the family I'm working for and my husband and me have 2 places.

They won't like it but we are planning to live together once we have enough savings?money so we can effort to live in San Francisco.

Anyways, good luck to you and I keep everyone updated on how my interview went, because it's gonna be a more complicated case.

I read on the USCIS Website that if you are married to a USC and worked without authorization that you don't have to file the supplementary form I-485 A, which others have to, if they worked without permission. That form is like a penalty since it involves a fee of $1000.

So, that leads me to believe that you won't be denied because of your unauthorized working. They will surely ask about that though, since - as sometimes said - you worked after you filed, too. So be prepared to justify and explain. Seems to me that you are, though! :)

but since I just received my social security number I'm gonna be able to start in May with my work on paper! Unfortunately (or actually it is good ) the process of filing to the interview date was about 4 months ...everything was happening really fast.
