Work with Co1 on H1b visa(GC sponsor) I have 2nd EAD .Can I work PT job on EAD in Co2

hi Team I have a question


I am working for Company 1 on their H1B visa ( 6 yrs expiring on April 2006).

Company 1 filed my labor in July 2001 and it was approved in july 2003.
Company 1 filed I-140 in Aug 2003 and it was approved in Sept 2004.
Company 1 filed I-485 in Sept 2003 and I am waiting for approval since 20 months.

My first EAD / AP / FP have already expired and
I have SECOND EAD / AP and 2FP done by company 1 .


I know I am portable under AC21 [I-140 Approved & I-485 pending for 20 months].


Question :1

After April 2006 Can Company 1 apply for E1B visa 7th Year ext
despite my labor , I-140 are approved or I will have to work on EAD only after 6
yrs expires.




Question 2:

Between now & April 2006 ; Can I work for Company 1 on h1b visa and work a part time
job using EAD for another employer .

or using EAD for second employer part time job also makes me loose my H1b visa status
with Company 1 primary job H1b visa holder & GC Processing company .


Question 3:

After April 2006 Can Company 1 apply for E1B visa 7th Year ext
despite my labor , I-140 are approved
and I have worked on dual status of H1b visa with Company 1 & used EAD for Part time job.

You can work part time on EAD and maintain your H1B status if you still work full time for your sponsoring employer.

You are wrong. If anyone uses EAD, you loose your H1B status at the very same moment. THen you can work even 20 jobs and your H1B becomes invalid.

hi Team ,

Another question. I have H1b visa with employer 1
Employer 2 is filing for another h1B visa for a part tme offer .
I will be working Ft with emp1 and Pt with emp2 .

Question 1; Can I start working with emp 2 once they have filed H1B visa petetion or do i need to wait for the approval .

Question 2; I last entered on AP through my GC process where I am waiting for I-485 approval from 20 months . I know i can switch under AC21 but if I work on 2 H1b does it do any changes to my GC processing .

'Want GC Soon' is correct. The moment EAD is used no matter for part time or full time or even for a very brief period, H1B status is lost.

In the link provided by voldemarv http://www.immigrationportal.com/sh...759&postcount=6 says "Just now I checked this with Rajiv on conf call. He said we can work as long as we stay with the petitioner. Thanks."

In other words the meaning of this statement is that as long as one stays with petitioner and is working on H1B not using EAD though has approved EAD, no problem. But still you cannot do any other job other than the regular job as long as not using EAD. If H1B expires during working with the petitioner employer and is not renewed/extended, EAD comes into picture. Then one can do what ever job he wants to besides regular full time job as defined in the labor.
Hope I am correct. Please correct me, if I am wrong.
