If one failed to get the j1 waiver and had to go back to his home country, can he continue work for his current US company from the home country? The company agrees to let him do so, even though there's no office etc in his home country, since the work is pretty much independent and doesn't have to be done on a site. Can this be counted towards the 2 year residency requirement? As far as I know, the rule only requires one to be physically in his home country, right?
Another related question: will he have trouble getting B visa to come to US in between for short visit if needed? The person currently has valid 3-year TN visa, but decides to go back to his home country to fulfill the 2 year requirement. If he still works for the same company (but from home) can he uses the same TN visa to enter US instead of obtaining a new B visa?
