Work Experience

My current company is filing for my green card LC.

1) I have Masters degree in same field as LC
2) 13 months Full time prior to current company
3) 2yrs part time work experince before joining my current company.
4) 5+months experince from current employer. still working with them.

Company Lawyer is stating that I need to have 2yrs of full time experince. And they cannot count the experince from current company ?

1) Is it necessary to have 2 yrs of experince from one company ?
cannot we combine experince from different companies ?

2) Can my work exp from current company be counted towards my work ex in LC process.

Thanks

No

Yes.

Also, in your case you cannot use experience gained as a part time employee. You have only 13 months of experience. You should ask employer to change the job requirement from MS+2yrs to MS+1yr

2) Can my work exp from current company be counted towards my work ex in LC process.
Usually no. There are many threads on this forum regarding this issue.

If you use your Masters (esp. US) to file under EB2, (check http://uscis.gov/graphics/formsfee/forms/files/i-140.pdf, under instructions for Professionals with Advanced Degree), you shouldn't need to demonstrate any experience at all, theoretically speaking, that is. I'm not sure if your lawyer is being extra careful, or if you're filing under EB3 (skilled worker).

Check to see if this is some Hr requirement in your co - if not, ask the lawyer to justify the need for the work experience for EB2

Cheers,

INS might be OK with MS and EB2 category.

But I won't suggest to use only degree (i.e. MS) as a minimum job requirement because DOL might consider job as a entry level position and look for campus recruitment activities.
