won't get i-EAD at local SFO office

I applied EAD 2 and half months back, my EAD expired yesterday,

I went to local BCIS office, 630 Samsone street , to check on i-EAD, There is notice posted there that, this office no longer issues i-EAD, mail your request to some address, and no other information.

Does any one know about this.?

I called Nation Customer Service, and they told me that it is upto local office to issue or not issue i-EAD. You have to wait till your EAD is approce?

Is there any other way to get I-EAD?

I asked, about whether i can go to San Jose ofice, and She said that no, for me since i am in Alameda county, i have to go to SFO office only, San Jose office will not issue i-EAD to me.

Any help is appreciated.

Did you tell the NCSC that your EAD was filed on so and so date, and it's been 90 days, and since it hasn't been approved you need iEAD.

If I were you, I'd go to SJ, they will probably look at your app and ask you to go, but tell them that you tried SF, and the whole story .. they *might* consider you.
 
That means, people living in Alameda county can never get iEAD? In case if current EAD expires and the renewed EAD is yet to come, you've to go jobless for the period in between? Is it not height of arrogance? Is there nobody in this world to question this BCIS's atrocities?

What is the alternative for this bottleneck? Is there way to get iEAD if both SFO and SJ offices refuse to give an iEAD?

I will definately try at SJ office tomorrow. ( they are open on saturday). BTW 15 days are remaininag for 90 days period.

That really is my concern. What happens if SJ office also denies. I will do some more reaserch.

As long as u work for the same client and if your HR does not ask about the EAD u need not have to worry ....

Try ur level best to get IEAD if not try to convince ur HR and work with the company ....

If I remember correctly, there were some earlier threads that says "having one current EAD is must whether your HR asks for it or not. Furhter having no current valid EAD will inavlidate your job and payroll at that time."

Goru: I also need to worry about this issue, if SFO refuses to issue iEAD. My current EAD is expiring by Aug 03 and I applied for a renewal only in Jan 03.

Experts,can you please clarify on the issue of working without getting any iEAD.

This is a tricky area to tread. Although some lawyers say that if EAD (renewal) application is pending then working is fine, there are others who mention the physical presense of a valid EAD at all times to work. Its a grey area. I would suggest trying San jose as the best option and try it immediately before they follow suit. Dont wait for research and stuff like that.
 
Not tricky

Technically, you need either ead, or iead, or h1 or gc or citi to work. End of story.

However, here is how you can get out of it.

Your EAD runs out, you don't have iEAD, you keep quiet, don't tell HR, your payroll runs as is, then when INS asks for paystubs, pray to god that the paystubs they asked for, donot include the months you were ead-less.

And w2s have no mention of money distribution over paycycles .. so u'll be fine. That ofcourse, if INS really puts efficiency into their system and 4 years down the line shares a database with IRS and finds out that you cheated .. UR DEAD DUDE. LOL .. but that ain't happenin' anytime soon.
 
You are mistaken

I read that poster outside SFO office.

It says they are no longer accepting applications for EADs . Instead they are asking to mail the applications.


This has nothing to do with i-EAD.

I believe i read Interim EAD, It is great if i am wrong,

I am going to SJ office tomorrow, and if that doesn't help, then i will go to SFO office monday and try again.

So can i apply for new h1b again, even when my -485 and EAD is pending, and my earlier h1b has expired some time back in November last year.(Just as last resort.)

I think you are suppose to go to 444 washington st for iEAD.
 
I agree. Didn't hear this from anybody else.

I will go get iEAD next week too.

Washington Streat, instead of. 630 Samsone Streat. My EAD will expire in July and I filed renewal in Jan.

I am living in MICHIGAN, Filed I485 in CSC on 01/13/02, Local DETROIT offcie denied to give I-EAD, So I flew from MICHIGAN to LA (downtown office )and got Intirim EAD within an hour. I suggest you to try in LA downtown office.

You are definitely eligible to apply. Soon as you apply you are allowed to work legally for the new company. That gives you sometime until your ead might get approved. :)

Perhaps you are misunderstand the post. When I went to San Jose to apply iead, there was some post like this. It seems for other iead application except I-485 pending. You should go to San Francisco BCIS to try to apply. I think you can get it.

Hi all,
I went to SFO, 444 Washingtn street location, and found out that they are giving i-EAD. They asked me to come back on 4th June, as i am finishing 90 days then.

630 samsone street is the same building but entrence on sansome street, and after talking to lawyer, found out that they must be processing i-EAD for family based cases, b'cos, what i was told is, for family based cases, they have to mail application for i-EAD, and then they send a letter of appointment to come on a specific date and issue i-EAD.
