Withdrawl form I-485 Processing

Hi,

We have applied for I 485 for myself, wife and my son 3 months back and now I am planing to send my son to India for Education.
Also, my wife to be with him in India. My son is 5 years old born in India.

Q1: I want to know if I withdraw my wife and son from 485 processing will that effect my greencard processing?

Q2: If there is any other means, I can process their GC in India while, I am within USA?

Q3: I am not sure how difficult to withdrawal from GC processing?

why do you want to withdraw their GC?

Have them leave with a valid AP, and let them come visit you every summer when you can appy for their next AP and so on, that way they will get approved with you.

The other route is that when you get your 485 approved, you can file a Follow To Join for your family and then they can get their immigration visa at the US consulate.

You have to remember that a person has to stay in US atleast 6 months every year to maintain the GC. So after your wife and son gets their GC, they won't be able to go and spend one academic year in India because that will require them to stay out of US more than 6 months. Ture that you can get Re-entry permit, but the processing times for re-entry permits are very long and you will have to keep getting them everytime they want to come and visit you.


Ans to your question.
1. Not if will not affect your GC processing

2. You can have them come visit you every summer and apply for their AP and that way continue their 485 processing.

I guess you have lotof money . Becuase you have to pay for withdrwal too. Next time if you ask the permission to them they may deny. So careful
 
also

it is very difficult to apply and get gc for them in future if you withdraw now.

My advise is better not to withdraw.

Why do you want to withdraw your dependents I-485 process!!
If you get GC (only for yourself) with out family members, you have to
prepare your self for many thing.
1) Can you stay away from your son & wife for a long time.Are you mentally ready?
2) Can your son stay in India with out you for long period?.
Atleast for a minimum of 5 years.
2) later,When you apply family based GC for your dependents, it will take long time.
3) It is very tough to get USA visitior visa for your family members when you have GC.

On the other hand, let the GC process to go as it is. After the approval of Gc for
dependents, Apply for the extended stay of dependents ourside USA(I guess, up to 2 years).
I believe for education purpose you can stay outside USA for more than a year.
After 2 or 3 years, you can decide either go back and settle in India or Bring your family
here.

Take a right decision. But keep in mind that your are responsible for your son's future and
you have to answer him when he becomes machured & grown up.
