Withdraw after Asylum Office "Notice intend to deny", and get back to home for DV Visa, or keep figh

Dear All,
Really need advice what to do:
I have got Notice of Intend to Deny(with no fraud, just inconsistent)
My I-94 expire at July 13 this year.
I was selected for DV2014, number is EU...5XXX
I did apply to extend my I -94 as DV winner in a beginning of May.
1) Withdraw my case, get back and get GC(would it be a problem?)
2) Or overstay my I-94 and and try to refute their arguments
3) Other options ???

One of my friend had his case pending at court and won the dv lottery as well. But he was told that he is ineligible for the lottery.
So, he is just fighting in the court.
Could you please share how long did it took for you to get NOID after your interview and which office handled your case?
