Will you be denied of the US GC if you have the Candian GC ?

Hi All,

I heard (let's say i read) on few forums that if you got your canadian GC during your waiting period(a long one though) for the US GC, can the USCIS deny your application ?

I do not see any logical connection there but when it comes to USCIS i do not think that they know what logical means :confused: !!

Can any one comment on this one ?

i do not think there is any connection..... people do it all the time (dual permanent residency application)
 
I got my Canadian PR paper and that never caused any conflict at all. As far as know those are independent processes, it is up to the individual to decide.

I didn't confirm this with a lawyer but i have friends here who mentioned the same thing that if USCIS finds out that you are processing permanent residency with ANY other country... they can use that as legal reason to void your Green Card application. Supposedly this means "you have no interest in staying in the USA"...

Personally, I don't give a damn about this: I got Australian PR processing right now too.
I am not willing to wait 10 years for a green card.

I am not the person you are refering to but you make a correct point. I have the canadian GC and when i was in India last month, they stopped me and asked me if i have the uk visa since my flight was stopping in UK. I did not have that and i had the advance parole so they say that it is not a valid Visa. Thanks to my canadian PR they let me on the flight. At the POE they did not looked at that so it was not a problem at all.

I have an RFE related question that i think you may be able to answer. They asked my wife about her current nonimmigrant status. Here is what I wrote so far for her, can you comment on this one ?

I am not currently enrolled in the school. I finished my schooling on June 2005 at Wright State University. I received the degree of Masters in Science. Upon completion of my degree course, I applied for the Employment Authorization through my school on July 11 2005. I got my approval for the EAD card and received my EAD card on August 22, 2005. As the Immigrant Petition for Alien Worker (I-140) for my husband was approved in October 2005, we both applied for our employment authorization in November, 2005. I got my second EAD card based on our pending application for adjustment of the status (I-485) on December 14, 2005. As of now I am a dependent of a principal applicant whose application for Adjustment of Status is pending.

Is this correct ? Please share your comments.

May I add my 2 cents?

If you obtain permanent residency in Canada country after you got greencard then that is a problem(in the US)

If you obtain permanent residency in Canada prior to getting greencard then that is ok for the US, but Canadian PR will become invalid.

I got this info from Canadian Immigration forums...not sure wether these are correct or not.

I don't know if the original poster is a person who contacted me yesterday. It seems that he landed in Canada and has greencard process going on in USA. Person at POE said they were going to notify uscis that he has taken up canadian permanent residency. We'll see how it plays out.

btw; i obtained australia/new zealand permanent residency and when travelling back to USA i used advance parole and my passport has a stamp from australia/new zealand saying i am perament residency. POE didn't say anything about it. The POE was in Los Angeles.
