Will using AP invalidate the H1 status?

1) If I have a valid H1 visa, but the stamp in the passport has expired, and I enter the US using my approved AP, is my H1 still valid and can I apply for the 7th year H1 extension based on my pending 140 and 485?

2) How does the INS know if I am using my H1 or EAD because I have a SSN which was issued to me when I was on my F1.

2. You would need to fill in the form I-9 which would show that you started using EAD, hence INS would know that you are working on EAD

Actually, we had a case like this last year at my company. My coworker entered using AP, she had an EAD but never used it, bacause her H1B was still valid. She didn't realize her EAD would expire soon.
HR got an opinion from 2 law firms, and they said she could continue working based on the validity of H1b.
