Hello all,
I am in the final stage of GC. I want to keep the H-1 backup if somthing happens with my current job. H-1 is expiring in 6 months time. EAD is in progress.
My question is will H-1 transfer as a backup affect my GC process?

Kalapani, I\'m not sure about the point of H-1 transfer. I was in a similar situation, and I just moved to my EAD and got out from H-1, upon advice from my lawyer. How exactly does your scheme work in case you lose your job?

Well I have 3 years left on H-1. But I have to transfer the H1 before it expires! If I don\'t do that I will come on EAD. And after that H-1 may not be renewed from US. So I want to keep a back up. In case I lose job and things can\'t be worked out, I would have the option to go on H-1 rather than being forced to use EAD (since 6 mo rule is not 100 % clear)But I raed somewhere that H-1 transffer means you are violating the intention of joining the sponsoring company after GC.
I don\'t want to do all this , but I am just thinking in case of emergency.

I don\'t know about your angle. But another angle to look at is if you change to EAD and then get laid off, you can always go back to your country and come right back on another H1, since you still have 3 years. But if you use up more of your H1 time, returning here with a H1 for lesser time would only make things harder. (Just my 2 bits).

I have used up my 6 years of H1. So not much I can do with that. Good luck
