We have seen two approvals for both I140/485 cases after responding for the I140 RFEs. Will this trend continue??? I hope so. I got a an RFE for category change and the response was received by USCIS on June 8th. If the trend continues mine and all others who have responded for their RFEs and did concurrent filing should get both 140 and 485 approved. It will be a great relief...what say you gurus???

It doesnt surprise me what you feel about your case being adjudicated concurrently... Everyone hopes that too, but I cant bank on it anymore as my 140 already got approved.

Good Luck..

Want GC Soon :)

category change

was your category change from EB2 to EB3?

The current trend shows concurrent approvals for EB2 only. So far EB3 cases hasn't been done.

Even mine was asked to change from EB2 to EB3 because the ETA labor advertisement was matching EB3 category even though I was eligible for EB2.

My RFE response was received on June 7th. So we should hear anytime now to another two weeks.

If you FP is done(and I think with this kind of RFE it is done), you have very high chance of surfing the wave. Relax and change the category.

Jharkhandi, how about this...

In my case there were two...change EB2 to EB3, and ability to pay. If they accept our response 'ability to pay' I140 should get approved in EB3. The name check should be complete before I485 approval. Can I485 approval happen at the same time for me with only 4 months passed FP and that too EB3. USCIS backlog reduction plan was promising faster approvals for EB2 category.

Yes mine was also from EB2 to EB3. I saw the two cases approved were for EB2. But I think categories should'nt matter for 485 processing. When we see the processing dates we have different dates for the 140 categories but there is only one date for 485 (it just says employment based adjustment applications). May be it was a coincedence that both we EB2.

You are also in right Q. Expect a favourable result.

By the way where did you read that backlog reduction is for EB2?

backlog reduction for EB2

A general statement given out when they introduced pilot programme in CSC, which was also true for backlogged cases.

Anyway let us see, we have two cases in line awaiting I140 approval in EB3 which are running in 15th month (ND April 03). The reason we didn't see any EB3 concurrent approvals because there are no EB3 I140 pending which are more than one year..i.e ND before May 2003. EB3s were always around 8 to 10 months time frame between ND and approval.

The California Pilot is the only thing that is for EB2. Backlog reduction is for overall cases and not only EB2
