Gusy,
Recently I have received RFE for employment letter and letter should have 4 things
1) Date of hire
2) Duties
3) Renumeration
4) Continued employment prospects

I got a letter from my lawyer like this

This letter confirms that Mr.XXX has been working with our company as a Senior Software Engineer since MM/YY (please fill in). His annual salary is $xxxx. This position is full time and permanent in nature and he has employment prospects with our company.

His duties include: blah blah....................................

If you require additional information, please feel free to contact me. Thank you for your attention to this matter.

Sincerely

I forwarded this letter to my HR and got an employment letter back from them having following words:-

This letter confirms that Mr.XXX has been working with our company as a Full time Senior Software Engineer since MM/YY (please fill in). His annual salary is $xxxx.

His duties include: blah blah....................................

Sincerely

This letter dosent have anthing to reflect continued employment prospect word. Will this cause any problem???

Thanks

Your attorney's version is good, I'm not sure why your HR will not give the letter in the same wording.

It would have been better to have the words 'prospect/chances of continued employment is good/excellent'. Very few companies will put in the word 'permanent' in there due to legal implications. You might want to give them a copy of your RFE and if possible explain to them in person the importance of that 'prospect' line in the employment letter. Best of Luck.

dont worry

in these times, it is hard to icnlude words permanent or continued prospects etc.
I sent a letter saying full time employment and employee in good standing.

I am having really very hard times getting that word on my employment letter. Guys please advice what to do, even my lawyer talked and it didnt help. Are there any chances of approval if that kind of letter sent to INS.

Actually I am not dealing with HR directly, my manager is talking to the HR. Last when I spoke with my manager he said that HR will talk to there manager and will let me know what they have done in past in such type of case. I am wondering if there wasnt any such type of case then they wont give me that letter which I want.

What were they saying, when you ask about the attorney's version? Why is it so hard for them? Just tell them that you'll have problems getting your GC, if they don't give the letter in Attorney's format. Your manager should put pressure on them.

Stating 'Permanent' might be difficult due to legal implications from the employers perspective.

You are not alone. Most of our friends here had the problem of getting such letter from their employer. Search this forum, you'll get positive reply.

I don't think USCIS will deny your case for want of certain words in an employment letter. This is nothing in face of the indirect amnesty that Bush wants to give illegals in form of a guest worker program. Don't worry too much.

Might be they will issue one more RFE and then the thing will be the same. I am not able to think what to do? Can anyone post any sample letter which got approved for the similar type of RFE.
Any help will be highly appreciated.

I also got a similar RFE recently asking for employer's letter indicating:
1) Date of hire
2) Duties
3) Renumeration
4) Continued employment prospects

They also asked for copies of last two years' IT returns and W-2s.

I sent the everything to USCIS and my online message got updated as below:

"We received your response to our request for evidence or information. It is taking between 365 and 540 days for us to process this kind of case. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case."

I did manage to get my HR people include in the letter that the prospects of continued future employment are excellant.

Thanks
TRISAM
