Dear Friends,

Please help me understand.

Will the new year bring additional visa numbers that will move the retrogressed dates? I know that there is an annual quota and for us Indians the dates are back in 1999.

Will the next year's quota kick in for Jan 2006 and start moving the dates forward?

i think new year for visas start in october.......and in fact uscis/dept of state calculates cutoff dates based on applications pending (or some sort of quasi statastics..., god only knows...).......so there will not be huge movement (like it happens in H1) at beginnning of year...
 
But, we did not not see much of new numbers in October....?

Infact, the dates have gone even back...

So anybody understands how this stupid thing called Green Card process actually works?

It is basic supply/demand. In Fiscal 2005 year (Oct 2004-Sept 2005) USCIS had 140K(where 10% quota per cuontry for all EB categories apply)+110K(I believe from the unused quota which is country independent). Hence there were more GC's doled out to Indians/Chinese. But starting Fiscal 2006 year (Oct 2005-Sept 2006) you only have 140K (which has 10% quota per country for all EB categories, ie approximately around 2000 for each EB category for India). Hence I don't forsee any big movements in the PD for the whole fiscal year if the law doesn't change.
 
people are getting one thing wrong.....some think that the PD are moving fast means it will continue at the same rate...........thats wrong....PD cutoff is moving fast right now because the number of cases with those PD are less than 1%...

some think that because the number of visa are less....the PD will move very very slow.....well i dont think it is the case..........i think after the old cases are approved...there wont be much left with old pd...hence it will move very fast.....but then it will get slower and slower....

my rough estimate is that PD will be behind the current date by:
...3 years behind for EB1
......atleast 6-8 years behind
......9-10 years for EB3

but right now EB3 does not look good...because most of the cases filed between 2001-2003 were EB3..

You are too pessimistic. By this time next year, all categories will be current, thanks to new legislation.

I am EB 3 India with a PD of August 2001. Do you think it is realistic to assume that my PD will be current before Jan 2008 ?
My Canadian PR expires in Mid 2008 and I dont want to loose it without having USGC in hand.

how come such a long expiry of 3 years for canadian PR

I lost it by just being out for 6 months and reinstating was refused too

According to new Canadian Immigration rules to maintain your Canadian PR one needs to be physically present in Canada for 2 out of every 5 yrs. That basically means you have chance to stay out of Canada for 3 yrs as lkong as after that you continuously live there for 2 yrs. The 6 months rule died some time back. Consult CIC website for details.
