Will the new H1b Memo impact AP POE

I had to make a emergency trip to India last week and now I'm planning to re-enter using AP.

1. I have a valid h1-B stamping in the passport till March 2010 . Will there be any questions at the point of entry on why I am using AP instead of H1b. What could be a legitimate answer incase the officer asks this question?

2. Can the new H1B Employer-Employee Memo issues occur in AP entries at POE?

I really need to travel back this weekend. It would be really helpful if you guys can share some thoughts.
 
Hi, I just returned from India using AP. My lawyer advised me to use AP instead of H1. I did not have any problem at POE.
