Hello:

My visa has expired 05/2000 (I last entered US 02/2000); but my I94 is valid till 03/2004.. So I am still in legal status right (legal presence in US)?

1) My ex-employer laid me off; but did NOT cancel my H1B; so my I94 is still valid right? If they DID cancel my H1; then is the I94 still valid? My lawyer said it is...

2) Will this cause any problems while NEW stamping in Chennai? As I don't have tax papers for 2001/2002?

ANY help is greatly appreciated... As this is very stressful for me.

chennai is looking at all previous tax returns. better option is try at mexico or canada with recent pay stubs.

How SURE are you about going to Canada/Mexico? Is Chennai REALLY that strict?

Please read the forums and you will get an idea.
I am in experienced with stamping in chennai or even canada. the information i have is only from the forum threads so please act accordingly.

1) WHat I understood from the Forums was that it is BETTER to goto India rather than get it done in MX/Canada...
2) Also, in case Visa is rejected there; One has to go back to India and get it done (We cannot re-enter US like it was before 9/11)

What are your thoughts?

From what I know chennai is asking for recently paystubs and all W2's of the previous years. Even the consulate at mexico and canada might ask for it(or actually asking for it). From what i understand chennai has a high number of refusals and people have been getting held up in chennai for 6-8 months in few cases. If that is not a problem and you have sufficient time chennai might be a safer bet.

Yes if your visa is refused in canada or mexico you still have to go to home country for a visa .

Also please note these are only my thoughts and opinions and I do not suggest anyone to act based on my answers. Its only information I have from the message boards.
 
Well; Thank You Pashwin....

1) AS I see it: If I goto MX/Canada and get refused.... Then I will have a rejection stamp on PP; so that will be BAD!! And will be harder to get a valid stamp in Chennai... so I guess it's better to try my Luck back Home...

2) And if I have to wait 5 months in Chennai; I have no other go.... I cannot produce my tax papers for 2001/2002 (I do have for rest of the years 99, 00, 03).... So in that case will they conduct an investigation or just wait for me to produce my papers (which I cannot do...)

3) If this approach fails: Then I will try for a L1 visa thru my company (We are a small consulting/outsourcing firm).. I think that might be feasible??
 
Irrespesctive of your I-94, If MX/Canada refuses you, U're headed staright back to India. You would not be allowed back.

Tax returns. You can order tax transcripts from IRS (Browse the CP forum) for free and get the copies of the actual returns for a fee.
 
Did you mean to say you did not file taxes for 2001/2002 or you do not have the copy of the taxes you filed?
 
Hi Pashwin: No, I did not file taxes for 2001/2002.
I already know that I can get copies of old filed tax returns by calling IRS...

H1 Revalidation

Hi Califnik,

Chennai Consulate is stringent interms of the papers. The following papers are required if you go for visa revalidation:

1. H1 Renewal notice or H1 approval copy
2. W2 for the last 2 years
3. 1040 for 2002 and 2003
4. Letter from employer
5. Photographs of your company
And additional documents as requested in their website.

Since you do not have a valid H1, it is a riskier proposition to try at Canada or Mexico. However, if you prefer to take risk you can try that option. Moreover, they no longer issue tourist visa to Mexico for Visa revalidation purposes. You can only try canada but you have a get a letter from INS to show the canadian immigration authorities that you are going for a visa revalidation.
Check all legal formalities before proceeding to Canada.

If your employer had laid you off what were you doing for the last 2 years. Did you not file for a new H1B? Has anyone filed a new H1B for you now?

Suggest you to get all your papers in US, go to Chennai and apply for Visa.

A> Yes, I did apply for a transfer, but my 1st lawyer totally screwed it up & I got rejected. Then I tried again on 04/2003 and got Approved 10/2003 till 04/2006 (The old I94 valid till 03/2004.)

I am on payroll since then and have got paystubs+W2 ONLY since that period (& also for W2 for 2000).

What do you think about this? I need all the help I can get.

Hi,

Since you have a valid H1 and last 2 months+ paystubs, you can try your luck with US Consulate at Canada. Call them, fix an appointment, get a letter from US Consulate, show that to Canadian embassy for a tourist visa and get a tourist visa.

I beleive you should be good for a revalidation of H1 visa.
