My sister(divorced, single mother of a 2year old(US citizen son)is a F1 student pursuing associate degree course in a community college, due to mental health problem she has dropped her fall classes. We got a letter from Psychiatrist(explaining illness that precludes attending classes)and a immigration attorney said in her situation a grace period for being out of status is allowed by USCIS.
I am not sure how long she will be out of status due to illhealth. We dont want to force her to go to school to maintain status.Therfore we want to look for alternative methods of keeping her in the country since all our family is now in US including my parents. My mother will soon be getting GC.
I wanted to ask you if my mother or myself should file for my sisters immigration.Or should we apply for asylum based on lack of social support(since none of our family is in India)/medical treatment/Hardship/care of US citizen child).
Has anyone been in similar situation. Please share your thoughts based on experience.A response will be very much appreciated.

hmmm... this is a very complicated situation u got on ur hand there my friend!!!! i think you should hire an immigration attorney as soon as possible!!!

Asylum is only granted for when the applicant is under political or religious presecution; not for personal health/family support/child care issues.
