Will i Have a problem in my interview..?

i have been in usa since 1994...

i have my interview 08/12/05 ....

this is my question......

look like they just look in records for the past 5 years u have been in usa.
in 2000 my son was born 10/17/00, i went to my country to wait for my wife to deliver the baby.... because my son was not doing well at the begining...
and i have nobody else to take care of her and my child.. i had to stay in my country for 8 months...... i dont know if this will hurt my continuos years i need to qualify ..... after 2000 i have been traveling 1 or twice a year to my country either to fix something or simple i just need to see and be with my family.. (notes trips never been more than 1-2 months after 2000).
 
Absence of >6 months breaks continous residence but it can be disproved.You have to show them the tax forms,any bank statements you had during that period,any bank/credit card activity papers,rental agreements,pay stubs like gas bill,telephone bill--all for that 8 month period.I had the same problem, and I showed them these along with my college documents as I was studying abroad.this should not be a problem at all if you show all this evidence.You can also say at the interview that your son was ill and so you had a genuine reason.If you have any hospital records of your son during that period that would help.And dont volunteer this 8 month break info unless the ins officer asks for.

doesn't he need to list the 8 months travel out of US on his N400 form? if so, the interview officer will know.

when did you mail out your applicaton form and what is your PD?
 
i think maybe is not going to be an issue....

in the list of paperwork the asked to bring....
they didnt mention nothing about tax returns papers.
just my passport, the SSS aproval, Social card. and alien card....

my interview is next months i just hope this wont be an issue.....
i can get a paper that will prove that my son was born in that date and he was hospitalize for 3 weeks... But after that i have nothing else......

so what u think?

it is the standard template of the letter. they did not mention about tax return.. and other stuff which does not mean they won't ask you to show.

when you were away for 8 months, did you file tax? did you have an apt / house back in US? bank acct? any indication of anything which you still had in US while you were gone for 8 months?

is the 8months away from US within the last 5 yrs since your filed your n400 appplication?

He should have stated that on the application. However he can state that his intetions were to return to the US. Will need to show proof of taxes, bills, insurance, rent payments and bank statements. That may help rpove he didnt break residency in the US. It is however, up to the IO who is handling your case. They have the final ok.

Have u declared the period of 8 months u were away in ur N400 application ?
