Will I Get Rfe For My I-140

Hi ,

We have filed my I140 petition with compiled financial statements only
but not the audited
we are not submitting company tax returns
we submitted my recent two w2's with the petition
company tax returns are not good.

will i get an RFE for ability to pay ?

your advice,answers will be much appreciated

Does your W2 show your salary is the same or higher than the PW?

first w2 shows more than the PW
second w2 shows less than the PW

I'm unable to say “yes” or “no” to your question because it is the USCIS that will adjudicate your I-140. But, I have seen the same supporting documents submitted without RFE issued because the beneficiary is currently making more than the PW. You do not need to worry about it if you are current salary is higher than the PW.
