Will I get EAD even though I-140 has RFE issued.

Hi,

How are you all? I have question related to EAD. Does INS approve EAD even though INS issued RFE on I-140? Does anyone got EAD approval in this way?

I received RFE for I-140 (financial ability for my company to pay). They need to submit profit & loss statement and other financial reports.

How long does attorney takes to respond to this kind of RFE?I received RFE on hand on april 23rd 2003. My attorney informing me that he is working on it.

I appreciate your response.
 
My understanding is that EADs are issued only after an I-485 is filed. Even in concurrent filing cases, I believe INS wants you to wait for the I-140 approval to come through (which typically happens well before the I-485 is acted on) before applying for EAD.

There may be others on these forums that may have a different take on this though. Good-luck.
