Hi, my situation is rather complicated. I entered the US in June of 2004 with a J1. I never showed up for my work. Instead, I returned to the same place I went 1 year prior to that and stayed here until this day. On my I-94 I have a D/S (duration of status). This year I applied for a h1b which was approved!!! I will be working in the education field - h1b was applied with the cap exemption due to ties with higher education. On my I-129 I admitted that I'm still in the USA. Now I have to go to the consulate in Cracow (Poland) to get the visa.
What are my chances? Does the consulate have access to any IRS files? Is there anything that could save me? Please help!
