Will I be allowed back in??

Hi,I am british, my father is american, my mother british, we lived in US for 11 years on greencard, We moved back to UK when I was 15 years old for 15 years, they moved back to US 7 years ago leaving me behind in the UK. All of my schooling was done in the US,I still have my old greencard and SSN. My Dad has just filed an I-130 for me, my question is I had a little trouble with the police when I was about 20yrs old, arrested for criminal damage and was given a fine. Will this stop me being approved for a greencard? I have had no other dealings with the police, not even a parking ticket! I am getting very worried about this, Please can you advise if it will be ok? Also how long will it take roughly, my dad works for the department of labor and is the one sponsoring me. Thank you in advance.
 
My understanding of your post is that you are over 21 years old right?
So you must wait for a visa number to become available. For the waiting you must check the current Visa Bulletin at the Department of State website.
 
I know that they make background checks and police clearance (if you are outside the US)...but some people over here even had shoplifting stuff and haven't seen any negative outcome, well they haven't posted anymore now that I recall. Just in any case when you file papers and they ask about previous arrests, just say the truth.
Since every country is different, what means a criminal damage in UK?
Remember to check out that everything is fine with the police and that you haven't anything pending.

Were you born in UK?

You said your father is an American, was he USC at the time of your birth? If so arent you a USC because one of your parents is USC? I could be wrong though. Just a thought.
 
Uhmm I didn't thought about that one...but I don't think so because he said that they were LPR's before...Jammer can you clarify, thanks!
 
1. Criminal dammage - I broke a shop window and had to pay for the replacement and a fine.

2.My Dad (stepfather) married my mom when I was 3yrs, so I was a LPR.
 
Okay, what Pinto was thinking then does not apply to you.

About your police issue, I don't think that will make an impact in your application was 16 years ago!, so relax. Plus you paid a fine. Anyway I won't worry so far since you still have to wait some years until your priority date.

Thanks, I worry because I never wanted to leave US, and have never settled in the Uk and now every memeber apart from me lives back in the US apart from my Fiancee (we are not getting married yet because of the whole green card issue) We are not sure about the best way to get her over there yet!! Any advice?
 
uhmm there is no easy way...because once you become a LPR then if you want to get marry, she must wait until her priority date becomes current once you can apply for her, and I am talking about years dear.
She should try -once you are close to get your LPR status-to apply for a type of visa like H1 or others that allow her to stay long period of time in the US so you can both be together. But that should be BEFORE you apply for her.

That is so far I know that can be done, unless in that period of time you become a US citizen and then things change and move faster.
