Hello. I am a British Citizen and my ex-wife is a US Citizen. We met while she was in England and we lived together over here for 4 years. She was diagnosed with cancer and wanted to return to the US, and I went with her. We didn't have time to file the correct paperwork, so I entered the US on the VWP. We applied to adjust my status to permanent resident, and it was approved and I was given a 2 year green card. After she had "recovered" from cancer, I wanted to return to the UK but she wanted to stay in the US. The marriage ended, and I went back to the UK before the green card had expired. My green card is now expired, and I want to go back to the US for a vacation, but have a few concerns. The process we went through for me to obtain a green card took well over a year, which resulted in me overstaying the VWP. Does this mean I won't be able to re-enter the US on the VWP as I have overstayed on it previously while waiting for my application for permanent residence to be approved? does overstaying on the VWP count against you while waiting for adjustment of status, which was approved?
