I-140/EB3 approved last month. My lawer is filing for 485/AP/EAD for me and my wife at VSC this week. My wife, on H4, applied to Universities for Graduate Programs, and has admission offers with tuition waver and assistantship (20 hours/week) for fall (Aug/Sep). Should we hold filing 485 and she take an I-20, get an F1 from Canada/India, and then file 485? Or should we take a chance and file 485 with her H4 status and hope that EAD is approved by Aug. I think even if we get 485 receipt, we should be able to get EAD in the INS district office by Aug?
Another question: My wife wants to travel to India sometime around Apr 1. Is it safe to do so if decide to file 485 this or next week. Is she required to be in US on the date stamped on receipt notice?
