Will EAD get cancelled, when I-140 is withdrawn?

Hello Friends,

I am in a terrible situation right now. I need your guys help. I am working for consulting company. I filed my I-140 and I-485 on Jun-04-2004. I got my EAD in the 2nd week of August. Now my company gave me 2 weeks notice of termination because they couldn't find a project. I will be terminated Sep-30-2004. I have only 6 months left in my H1-Visa. Following are my queries:

1) Will my EAD get cancelled if my employer withdraws my I-140? If my 140 is withdrawn, can I atleast work for a different employer until my EAD gets expired. My EAD expires in August 2005.
2) Being 2 month left to complete my 180 days for my I-485, I am safe at this point. Did any one got his/her 140 approved when they terminated 2 month before they are suppose to complete 180 days.

No you lose your EAd once 140 is withdrawn.

180 days rule applies only after 140 is approved. Request your company not to withdraw the 140 and answer any RFEs.

sorry to hear that. exactly samething happend to me. I was laid off, since company did not get any new projects and they gave us 4 weeks salary and let go. So I requested company to not to withdraw I140 and asked for help, if in case of any RFE. my I-140 was querried for 2001 company tax returns and company provided that info. so attorney replied and waiting for approval. Company treated my case as exceptional since I worked for that company more then 4 years.


Just speak with company for support till I-140 approval then tell that you wont bother them after that and trasfercase usig ac-21. Now a days, new applicants are getting fast approvals. you may get it approved anytime.

A quick question -

If you applied for your 140 & 485 in JAN /2004, How do you say that you have 2 mths yet to complete your 180 days?
Am I missing something....
 
This is called optical illusion. My computer shows date of Jun 2004. :D
