will a Class-C misdemeanor(first time window tint violation) affect naturalization?

My lady friend will be eligible to submit her N-400 in about
5 months.

She has never had any trouble with the law... not even a
parking ticket during the entire time.

However, last week, she received a ticket for illegal window
tint on her new car. The tint shop had used a 50% tint
on the front door. The state law is 43% net, so she should
have no problem. Unfortunately, the new car that she got
had factory heat resisting door glass that has a VLT rate
of 70%. 50% times 70% turns out to be 35%. The state
trooper who issued the ticket had a little gadget that can
measure the VLT rate. It came back as 38%, so he issued
a ticket. Under the charge he wrote "illegal front door tint,
38% field test..."

My lady friend thought it was not a big deal, probably a
fine and the removal of the tine should take care of it.
Well... not so... it turns out that the window tint violation
is not considered a traffic violation in her home state. It's
actually a Class-C misdeamanor. It cannot be prepaid
by mailing in a check. She is required to appear in the
local county court.

What should she do now? Should she hire a lawyer(either
traffic, criminal, or immigration) to help her fight this case?

For what it's worth, she already had the tint shop guys
take off the window tint this morning...

Thanks for any suggestions.... Please reply as early as
humanly possible, because the ticket has a court date of
August 29 written on it....

Are you serious dude.!God only knows how many times I did it only to get ticket from cop.As far as I know if she took it out.Just take picture and take it to court and tell judge she was not aware .He should let her go unless it is repeated offense.Fine and court will be there.Next time make sure she cuts the top portion of the window to that level that thier meter cannot go that low :p .Amatures!!!!:D

If anything, it is the shop that applied the tint that should be responsible. Any normal person would not understand those technical percentages and would expect that the shop would stay within whatever the legal limits are.

Win or lose, she still has to get the court records and include them with the naturalization application. But it would be ridiculous to be denied citizenship for such a technicality.

The only thing the IO is going to do is laugh at how stuipid going to court for this is. You won't have any problems unless they found a couple of dead bodies behind the tinted window...

Most Class C misdeamanor will not affect citizenship process.

The only time they would be an issue - if you get dozens of them within a year...showing bad moral character.

Tell you friend to be truthful about it....and there should be no issues.
