Wife's Consular Processing in Islamabad, Pakistan?

Hello All,

I am originally from Pakistan. I went home in Jan-Feb 08 time frame while my I-485 was pending. I got married in Feb 08 and came back to the states. My wife got her passport made so she could apply for H-4 based on my H-1. But before she could apply for H-4, my I-485 got approved in March 08. Since I got married before the 485 got approved, I qualify to get my wife's case processed through Consular Processing.

Has anyone gone the same route and specifically through the US Embassy in Islamabad, Pakistan? If yes, then what is the estimated time frame?

How long does it take for the US Embassy in Islamabad, Pakistan to process once USCIS has notified them?

Any help would be appreciated.

Thanks

Hello,
I think USCIS does not notify to US consulate. I think USCIS will notify and transfer your case to NVC (national visa center). And if priority date is current then NVC will send you instructional packages. you fill up the forms and pay the visa fee. Then NVC will notify to US consulate and and interview will be scheduled.
NVC is pretty fast if priority date is current.
And being a woman, I think your wife won't get stuck in name check etc. So, that should work.
consult with your lawyer or do some more research before making any final decision.
good luck.

faranianq,

Thanks for your reply. How do I find out the priority date? Would it be the same priority date as mine? Mine was filed in EB2 in June 2007 and the priority date was current so we filed concurrently. Would my wife's case have a different priority date?

Regarding the final decision, my lawyer already filed I-824 earlier this month (April 2008). According to the USCIS website, they are processing I-824 applications filed around 28th October 2007.

I would appreciate your help.

Thanks

Hello AV8R,
Your wife's priority date depends on when her case was filed. If it was filed when your I485 was in process (looks like that was the case). Then her priority date should be current as your priority date was current at that time.

As you have already filed for I824 that means your wife's case is current and there are no delays.

Now the only delay is approval or I824 and transfer of your case from USCIS to NVC. (And that may take upto 6-8 months as per my information).
Once NVC receives your case, it should move pretty fast.

Please consult with your lawyer as this is just my opinion and I am not an immigration professional.
Thanks.
