Me & My wife have EAD and H1 & H-4. H1/H4 valid till Sep 2004 and EAD till June 2003. My wife started a company using her EAD in January 03. I recently got laid off from my sponsor employer. Waiting for an approval/decision pending since 16 months. My question is can I join my wife's company using my EAD and have her put me in her payroll using the same title and salary structure. It is noted that INS issued RFE for paystub, and employment letter at this stage no company tax or financial information required. My concern is if they ask for newely established company we might not be able to provide necessary documents. This is probably not be temporarily I may join FULL TIME and work for my wife's company if things work out they way we are planning een after green card.
 
I am not answering your question but would appreciate if you can post the steps that one would have to do to start own company on EAD/GC?

It is quite simple. If you or your wife have an EAD you can open up your own company: S-corporation, Sole propritorship and Corporation. Depending on the state you can either ask any CPA to register company for you (You ofcourse have to give them the name of the company and fee). You can also visit your state web site and save some money normally it cost $200 to register a corporation. You also need to open up a business bank account. If you have employee on your payroll you must have workman composition.. Good luck
