Wife took Voluntary Departure at POE...

I am a US Citizen now, wife had taken Voluntary Departure(Dec 2008) at POE as she was stopped and questioned for coming in the country so often....her visa was revoked and A # was created and has 2 codes 1) 22 CFR 41.122 h3 2) 212 a 7A(i)I

must add she never overstayed her I 94.

Its been almost 2 years since the incidence.

I am filing her I 130

do I need a waiver in this scenario, if yes, which one?

I will appreciate all your help...

On what basis was she refused entry, suspicion of overstaying on a nonimmigrant visa?

It appears that she either had documents without the proper duration to enter or had been coming too often or failed to acknowledge that she was the wife of a LPR which would make her a likely overstay.

You need to be working with an attorney for any filings on her behalf. Doing it wrong will make matters worse. You would be foolish to try to handle this based on information and advice from an online forum.
