OK...here is my situation...i am in USA...came here 8 years ago on F1, then got H1, now on 485....going to India to get married in a couple of weeks...while ofcourse i will bring her here to USA on Follow To Join (a complicated US immigration process), but i just wanna also apply on the side to canada...now...i totalled my score...it is 72...i am running short of 3 points to score 75.

i believe my future wife's education can help me score those 3 points:

here is the deal:

After 12th, she joined Commerce...did SYBCom and has 2 ATKTs...then she dropped out...never completed her BCom...i.e. 13 years completed, failed in 14th year and then dropped out.

How many points do I get off her?

The Spousal points are:

(1)Seconary School (12th standard) complete: 0 points

(2)A Diploma or Trade Certificate or Apprenticeship AND 13 years completed: 3 points

(3)A Diploma or Trade Certificate or Apprenticeship AND 14 years completed: 3 points

Now...I think she fits in the 2nd category...since she has completed 13 years of education i.e. she passed FYBCom...but she does not have a diploma/ trade certificate/ apprenticeship. OR
does this mean she is in category (1)...since in catrgory (2), they have clearly specified that she should have 13 years education "AND" diploma or trade cert. or apprenticeship...with emphasis on the "AND"

If she is in category(1)...then I get 0 points from her...if she is in category (2)...i get 3 points from her and I reach 75 points...please advise.

I need answers from y'all within 2 weeks.

Since ther is no"diploma" at the end of FYBCOM, i do not believe the points will count.
Check and see if you fiance has done some private short term certificate course (computer appl etc) and then you may take a chance.
