Why is the priority date not moving?

I am a unmarried child of a US Citizen (1st Category) - my PD is 09/2002, my I-130 was already approved, I check the Visa bulletin every month and the priority date is STUCK ON THE DREADED APRIL 22, 2001 for my category. I mean, it's been stuck there for many months. Can anyone explain to me why that is cause I've contacted CIS and NCV and the local office and nobody can give me an answer.

Also, some sources tell me that I can file I-485 and EAD and wait while I'm waiting for the case to become current (on the basis of the approved I-130). Other sources say I can't do that. I just want to get off my current H1 status and be able to apply for another job with the EAD. Can anyone help?

I bet this is because they need to spend the quota on taking care of the applicants who fall under 245(i). Once the PD passes through 4/30/01, I believe the line should move much faster. (Just my guess)

You can't file neither I-485 nor EAD until your PD becomes current. I'm 100% sure on this.

Can you please explain what is 245(i) and why is 4/30/01 an important date for this type of applicants?
 
same category, pd 03/02
i dont check visa bulletin anymore since its not changing for almost 1 1/2 years. i called us ambassy in berlin a month ago and they told me, it could take 1-2 years more till my pd becomes current.
i just cant belive, it takes 6-7 years to process 1st priority case. fucking crazy :mad:

How did you get your I130 approved? My PD is 11/2002 and the I 130 was moved to california service center in March, 2006 and no news about it at all since then. It will be my New Year resolution not to check the visa bulletin until 2008.

Tell me about it, I've been waiting for 6years now with a PD days away from the current bulletin. My grandma just pass and I'm stuck here nto be able to leave or I'll be ban for ten years :mad: land of the free, home of the brave. If only i could turn back the hands of time.

I got my I-130 approved in May 05. I've been checking the bulletion since once I found out that my green card depended on that bulletin date. Someone suggested that the date is not moving because of the LIFE act applicants. What I do not understand is HOW COME LIFE ACT BENEFICIARIES WHO ARE BASICALLY ILLEGAL ALIENS WHO BROKE THE LAW AND GOT IN ILLEGALLY have priority on aliens like me that have entered and stayed in the USA legally all the time. This is mind boggling.
