Why is my I-485 not getting approved???

Hello experts,

I would greatly appreciate if someone can throw some light onto why I-485 EB3 Labor substitution case (filed at VSC) is taking such a long time to get approved? The PD for my case is October 2000 and the I-485 processing date at VSC is Feb 15th 2005. My I-485 was filed on March 18th 2005. I thought that one can expect to get I-485 approved anytime soon after the priority date becomes current - and mine became current almost 2 months back.

Can I expect to get it approved anytime soon after VSC processing date for I-485 moves to March 18th 2005 (when my I-485 was filed)?

We received a medical RFE on wife's case 2 months back as we never submitted her medicals - which we later did and the INS received it on February 23rd. There has'nt been any LUDs or status changes on our I-485s since Febraury 28th (both me and my wife)?

I am in a very delicate job situation and I am having sleepless nights hoping that mine and my wife's I-485s get approved ASAP. I would greatly appreciate any guidance on when I might expect it to get approved.

When you answer RFE, they normally say they need 6 months to receive your RFE and process the case, after 6 months you can ask what happened with RFE - not earlier.
Of course they may - just may - process earlier.

In addition, you may stuck in the name check process for many years...like me with my PD always current.....

WorryForGC - yes I was working with GC sponsor on H1B at file time.
compass - I was'nt able to get my wife's medicals reports in time last year as I had to file her case before June 30th deadline. But I had her medical reports (Form 1-693 and supplemental) by july 15th. Back then I asked the immigration lawyer whether it would it be OK to send her medicals immediately to INS (also consulted these forums). But everyone told me to wait for a medical RFE as that way it would be faster compared to if I would have sent them to INS in July 2005. So I am confused as to how come medical RFE whould delay my process - when infact I was told not to submit the medicals before.??

Experts please suggest..

You should've gotten the required (related) list of application at file time and file them along with your I-485. With a little reading/research, you can get that list from the USCIS form download page. I remember filling up half a dozen application. I don't have the exact list, but there were application for medical & biodata, also AP (optional) among the others. I filed both I140 & 485 concurrently.

It's not 6 months, but 60 days wait after you submit RFE. After I submit my RFE, the LUD changed instantly and it mentioned if not heard within 60 days, contact them. I did contact them after 60 days, now another 60 days have past but I don't think it will make any diference if I contact them again since my PD is not current.

But it's true that just bcoz your PD is current doesn't mean your NC is cleared, and if not NC cleared, you'll have to wait until it gets cleared.

So, start bugging everyone you can think of, FBI, your local AOS, congressmen/congresswomen.

Still confused....

I will try to explain my situation again - more clearly this time...

I filed my I-485 and I-140 concurrently in March 2005 as labor subsitution EB3 category. Got married in April 2005 and managed to file for my wife's I-485 just before June 30th deadline - but in order to file it before the June 30th deadline I was'nt able to get file her medicals (Form I-693) along with I-485. But soon after filing for my wife's I-485 I got her medicals done by July 15th 2005. I asked my company's immigration lawyer and also discussed this on the forums about sending the medicals to INS so as to avoid receiving a RFE and unduly delaying the process. But everyone suggested me the same thing - that to wait for medical RFE and sent the medicals only after receiving the RFE as this would be far better than sending the medicals at that time.

Your I485 RD is March 18th 2005. As of March 20th, VSC is processing cases dated March 1st 2005. When you originally postedyou noted that VSC was processing cases received in Feb 2005 which is before your RD.

Wait until VSC's processing date passes your RD. Then will be time to start asking questions. Right now VSC is still processing cases received before yours.
