why did they collect my I-94 during the interview?

My EAD card was late and DMV gave me hard time.. I had my pasport, ssn card, I-485 even I-765 the receipt notice plus the one with stamp and signature after being fingerprinted - they were yelling too bad you dont have I-94 with you that would solve all troubles..

question then: why did they collect that document during my interview back in August 2006? (I am still in a background checks loop)
 
In almost every state in the United States, DMV don't issue DL or Non-Driving State ID to someone who is not legally authorized to live in the country. That's why they need either valid I-94, green card, or something to verify the legal status.

Foreign passport, SS card, the receipt notices for I-485 and I-765 are not a proof of your legal stay in the country. That's why DMVs don't accept these documents as your legal status. You don't have ANY status as of now. USCIS can even detain and deport those who have pending AOS because nowhere in immigration laws it states that INS cannot detain and deport anyone who has no status nor does it state that filing an application automatically gives an status. However, INS don't detain and deport people have a pending AOS which is as a matter of their interim policy than as a matter of law. Law does give Attorney General the discretionary authority to adjust their policy on this. So, all these documents cannot be accepted by DMV as a proof of legal status.

Also, if your I-94 is not valid then they would still not accept it even if you would have it. As for why USICS took away your I-94 is because they always take away EAD, AP, Re-entery permit, I-94 after the interview because applicants don't need them once AOS gets approved. Officers need to collect these items to place in the file. But some officers forget to collect them by mistake. In your case, you were already interviewed...so once background checks get cleared, you will get your GC in the mail...There wouldn't be any need to go back and be re-interviewed again. That's why officer already collected that. Besides, you don't need it anyway.

thank you Johny. We have been requested for second RFE our case is in 3rd party checks in loop since August 2006 (we are considering WOM) so probably we will be interviewed second time..
anyways thanks for explaining that I94
