Why CP over AOS?????

Hi All,

I'm just kind of curious as to what some of your thought processes were to opt for consular processing (CP) over adjustment of status (AOS).

According to what I have heard so far CP takes anywhere from 4 to 8 months to be called for an interview. However, if you decide to go the AOS route, you're pretty much considered a permanent resident after your AOS application has been pending for 6 months although the approval can take anywhere from 12-24 months. Also, AOS seems to be a lot safer since your LOC and I-140 will still be valid throughout the process and after 6 months you're free to switch jobs and so forth.

So, what was the reason that some of you guys selected CP over AOS?

Thanks for the link. But, I still don't understand why people opt for CP over AOS because under the new laws AOS applicants are granted pretty much all the privileges of a permanent resident after the application is pending for 6 months.

However, if you choose CP there is a chance that you will not be even called for an interview after 6 months.

Am I right?

yes, AOS is preferable now

With AC21 (hoping the final regulations will be favorable to the applicants), AOS is not a bad choice at all. Once you are out of the country, it becomes very complicated in case of denial.

Thanks so much. That is the exact answer I was looking for. Also check out the following web site for a recommendation for AOS over CP given the current economic conditions and new immigration laws.
