Who to contact if clearance is late?

Hi All,
Does anyone know the proper channels to follow in order to find out about the security clearance (name check) ???
For example, i've read that some people contacted the FBI office to find out about their clearance because it took a while, what department to contact? what number?
The USCIS 800-# is useless. They never give me the right info.. i always have to ask to speak to a USCIS officer just to make sure... they gave me wrong info many times and a lot of times they've also refused to transfer me to an officer. All they tell you to do is WAIT.

Thanks

You can take an infopass appointment, and try to find out about your name check clearance, or you can contact your congressman, and ask him to make an inquiry on your behalf. I personally find the second one to be more effective, but you might get some info at the InfoPass, as well.

meemo,
I am in the same boat. We did our AOS interview with a current number on Apr 24th, but my name check was not clreared. We had done our finger print just 3 weeks before the interview on Mar 31th. How late is yours? How much time should pass to call it "late"?

Thanks

Our interview is coming up in late July, so i guess i have some time. However, we've done our interview late May, so by end of July, it should be exactly 2 months. I hope it'll be cleared by then. I honestly don't know what is considered late and what is not. Someone on this forum said it took 11 weeks for her name to clear. So, i guess 12 weeks is sufficient before starting to worry... then again, i guess i'll be really worried if it's September 1st and name is not cleared yet.
I called USCIS and asked about it, they don't have any info and my online status hasn't changed since they posted that my I-485 was received. They don't even know who to contact or what to do if the name clearance is late. Also, they don't know how to proceed or how to deal with it.
Anyways, if by the interview date, it's not cleared, i'll ask during the interview for them to check up on it, or send a request to the FBI to get an update.
Good luck to all of us.
You can always make an appointment and see an INS officer. If in person, they might give you better info than the phone.

Usually when somebody is called for interview their name check is cleared. I have almost 2 months since my FP and no interview date yet. Somebody else from the same city as me, but different case, who had the FP on the same day as me, already has an interview date . So the logic is not logic sometimes.

alincosma,
it's not necessarily true... there are some people on this forum who had their interviews before they were cleared... so they had to wait 'till they were cleared before they got the GC.
I guess some places have higher load than others and take longer. Hang in there and good luck

Meemoo
thank you very much for the encouragement words. I do hope me and my wife we'll get it soon. good luck

How to determine if your Name Check has been cleared or not...

Hi Meemoo,

Can you help me understand how should I determine whether my Name Check has been cleared/has been already sent to FBI or USCIS are still waiting for FBI reply?

Can you tell by your I-485 online status?

Also, are all I-485 cases actually invited to an interview?

I'm on EB1 Employment based GC and got my I-140 approved. So now trying to figure out what are the next steps/barriers…

Thanks,

Rambi.

When I had an infopass in April and spoke with an immigration officer she told me that in some cases if everything is alright with the file you sent them and if they have everything in there you can be granted residency without interview.
As far as I know the only way to check for the name check is to speak to an imm. officer or somebody from immigration.

I heard a lot of people that apply for the GC through the employment get permanent residency granted without an interview, never heard of anybody that applied for the AOS as a DV winner and get a GC without any interview. It would be so nice if it happened :) :) :)

Hi,

if I make an InfoPass appointment, can they tell me if I have an interview date set?

My story is that I had some problems with my address and post office. They tried to deliver something about 3 weeks ago and failed, package was returned to the USCIS. I have no idea why it happened, because previously without any problems I received my Notices of Action for the I-485 and biometrics. I requested them to resend the package. I went to the local office once and they told me that they dont know anything because it is all MSC and that I should wait until MSC resends it. Today my lawyer found out that the local office received my file in the beginning of May. So I would like to make an InfoPass appointment and try again to find out what they were trying to send and if I have an appointment day set.

At an infopass they should be able to tell you if you have an interview appointment set. How did you find out that they send you a package and delivery failed? Your case seems to be going so smooth. Good luck and keep in touch

On the USCIS webiste where you can check your online status, they also allow to setup an account and then you can ask to receive automatic case status updates to your email address. Around three weeks ago I received an email:

"*** DO NOT RESPOND TO THIS E-MAIL ***

The following is the latest information on your case status

Receipt Number: MSCxxxxxxxxxx

Application Type: I485 , Application to Register Permanent Residence or
to Adjust Status

Current Status:

Our last written notice in this case was returned as undeliverable by
the post office on May xx, 2006. To update the mailing address so this
notice can be re-sent, please call the National Customer Service Center
at (800) 375-5283.

If you have questions or concerns about your application or the case
status results listed above, or if you have not received a decision or
advice from USCIS within the projected processing time frame*, please
contact the National Customer Service Center.

National Customer Service Center (800) 375-5283.

*The projected processing time frame can be found on the receipt notice
that you received from the USCIS.

The U.S. Citizenship and Immigration Services (USCIS)"

This might not be an interview notice. When I received the first Notice of Action I noticed that my first name was misspelled, I called them to inform about that and the Immigration Officer told me that they will be sending me a letter informing about that change. So that package that they were trying to send might have been that letter telling about the change in my name.

So, in general it is not going that smooth. :(

I just got call from my lawyer and he got an interview notice for me today. It is a very good news.

To Alincosma: Hopefully you will get your interview notice soon too.
