Who to believe Lawyer/Senator

I had the interview on April 11th 2005. My interviewing officer was very rude with me and he gave me the “Decision can’t be made at this time” letter. It has been more than six weeks I haven’t received anything from them.

I hired a lawyer to check on my case and she received an email from Interviewing officer saying “A decision has not been made on this case, It is being reviewed”. My lawyer is telling me that the adjudicating officer is sitting on my case. That is where my case is.

On the other hand, I had gone to the Senator’s office and the staff called to the INS in front me and she had requested the status. INS responded saying that my application is on the “Name Check” process.

I don’t know who to believe, I really have to travel overseas and I am afraid if they will stop me to come back since i had some complecation during the interview.

Please advice.
 
Both are right. The immigration officer is formally reviewing your application while waiting for the name check to be done. It is a polite way of saying @#$% off and wait!
 
I guess you are stuck in the name check thing. CIS will disclose more information to the senator office. Also the officer reply does not contradict with the name check review. You application is under review for name check :(
