Which Scenario's cause LUD changes on approved I140 and pending I485 on the same date

Hi

Can anyone comment on

What are the possible scenarios where a LUD changes on approved I140 and pending I485 on the same date.

Because my case had a lud change for both I140 and I485 on same date with no message change.

I am really getting concerned.

My case details are
I140 ND mar 11, 2003
I140 AD mar 2, 2004

I485 ND Oct 22, 2003
EAD1 ND Oct 22, 2003
AP1 ND Oct 22, 2003
EAD1 AD Jan 2, 2004
AP1 AD feb 8, 2004

EAD2 ND Sep 7, 2004
EAD2 AD Sep 20, 2004

AP2 ND sep 7, 2004
EAD2 AD Sep 28, 2004

FP1 Sep 3 2004.. LUD change on I1485 sept 9, fp received case resumed

I485 New LUD 11/4/2004 No messsage change

I140 LUD change 11/4/2004 no message change.. status say approved on mar 2, 2004

I did call

I did call twice with a gap of two weeks

First time the lady said no need to worry.. just wait.

Second time the guy told that it is assigned to officer and u have to wait.. But both times i did not ask about I140.. I asked just about I485.

Do u suggest me to call again and talk about I140.

There as a LUD change on my I-140 case and no message change. My I-140 is approved. Do you see something wrong?

you are already approved on march 2004..and your 140 LUD should not change..how long you stayed with employer after gc ?

you should call up and find out the reason of 140 LUD change.. typically after approval this LUD should not change..good luck

I did change my employer on June 2004, but only after i completely qualified for AC21.Which is (6 months after I485 is filed and I140 is already approved).

Also i did change the employer only after taking my lawyer opinion and couple of other lawyer opinions. All of them said i should be fine to change employers.

Also i do know that my old employer sent a revoking letter for I140. So my new lawyer sent AC21 letters. (New employer letter with same skills and position and i am also getting exact salary as LC)

So my concern is whether the change in lud for I140 is due to my AC21 letters or due to my old employer letter to revoke my I140 or for any other reason. Do u remember any other case of similiar nature.. if so can you please let me know

Also do u think it is okay to call VSC center almost on weekly basis regarding my case. Do they keep track of how many times we call.
 
As you qualify for AC21 there is no need to worry..140 withdrawal notice may trigger NOID.. all such NOID are subjected to supervisor review.. so even if an officer denies 485 supervisor may override the decision.. ( thats why few people know that there is NOID and still no notice has been mailed out ) read page # 194-198 of 485-SOP I am attaching ( page 189 have information about visa # ) ..i see you getting into no problem at the end..

i would not perfer calling USCIS every week but this situation is diffrent

I will keep updating this thread as and when i hear something on my case

Also it has been more than 2 months since that lud change.. thats why i started to get concern.

At the final processing. It seems like they will keep all the 485 files on visa hold. From this it seems to me that they are not process the cases whose PD is not current. and also the approvals we are seeing hear and there might be those cases which passed this process step i guess. WHat do you think.

Visa Hold If the applicant of the I-485 meets interview waiver criteria and all of the required evidence is acceptable and present but the visa is no longer Immediately available due to processing time between filing and adjudication of the application, the case will be placed in a processing hold. If you place a hold on a principal applicant, the same must be done for each dependent. To do this, follow the steps below.

1 Check off .N. under .Visa Availability Confirmed. in the .Adjudication. section of the I-485 Processing Worksheet and initial and date the same.
2 Update CLAIMS by accessing .Adjudicate a Case. and wand in the barcode of the I-485.
3 Hit .F10. and select .Case Review,. then .Place in Suspense. and lastly, .Processing Hold Placed..
4 Hit .Esc. three times to exit this form.
5 Route the file(s) to the Visa Hold Shelf.

Place in Suspense OR Recommended Approval ( page 190 )..there are two states where you are approved in all respect but yet to get a VISA #
 
Top
