In the current situations, is there any advantage (or disadvantage) in CP over 1-140/485 concurrent filing?
Our situation is My labor is pending. I am planning to file 140/485 concurrently once my labor approved. Now I have one year left in my H1. But now my wife wants to apply 140 (EB2-NIW) self petition w/o labor. If she files 140/485 concurrently, I may not able to file 140/485 concurrently when my labor cleared. I read somewhere we (both husbund and wife )should not file 485 two times. Can we file her 140 with CP. Will it be any issues doing so? If CP is opted, what one should do (being in USA) after 140 approval?
