Is it correct that we can get the interm EAD from the local INS office and if not, then where?

What docs do we have to go with and is it a walk-in or we have to schedule an appointment?

Please reply...Thanks in advance..

I think you can get the interim EAD from the local INS. To my knowledge, you need:

1. Copy of your current valid EAD.
2. Copy of your EAD Receipt notice.
3. Latest photographs, like you did before for EAD.
4. To be safe, take your current Employment Letter and paystubs and your passport.
5. Copy of your latest I-94 Copy from your passport.
6. Fees, check with somebody about this, I don't know if you have to pay the fees for Interim EAD.

Maybe others will rspond to my list given above.

wrd1,

I am in the same boat. I had to get an interim EAD almost 3 months ago. Kilaru's list is very good. I would just like to add that you also need to take the following:

1. Actual I-94 card. BCIS will want to know if you have appeared for Special Registration, although this only applies if your contry was on the blacklist (India for example was not on it).
2. The original I485 Receipt Notice. They asked to see mine.
3. Your actual EAD not the copy. If they issue you a new one (assuming you already have one) they will keep your original.

Of course you need to wait 90 days before trying to get the interim EAD. Once 90 days have elapse you can simply walk-in. Regulations may vary depending on the field office.

good luck,
sadiq

Thanks for your inputs. I really appreciate that.
I never had an EAD...This is gonna be my first EAD as I am having h1B. Will they give an interm EAD even though this is gonna be my first EAD? Please post your opinions...

Thanks

WRD1,

It depends on field office plicy, but from my limited knowledge I don't see why they won't. According to BCIS policy, they are authorized to give interim EADs if the I765 petition is pending adjudications after 90 days - go on your 91st day. You have to surrender your old EAD if and only if you have it. In either case, it doesn't hurt to try.

best regards,
sadiq

p.s. not a lawyer so this is my opinion only

Got the interm EAD

I got the interm EAD(my first ever EAD) from the local INS. They didn't ask me anything but the EAD receipt copy...Fee is waived because it was already paid to INS(NSC). I got it in 10 mins but had wait in the line for more than 3 hours bcos I want at 8 AM. Guys go sooner if you want to get out sooner. Thanks a lot for your advice and help...

Congrats WRD1,

Did you take any prior appointment at the local office or did you walk it at 8.00am.

Thanks
