me too in same boat..as we see CSC is following in many cases LIFO process...if we are lucky we should get ours soon....if u see some 01/01 , 02/01 guys are also getting approved in past few days...also some of the ND 03/01 guys haven\'t received FP notices !! we are in good shape ..dont worry !!

I think our case might have assigned to some shit IIO. I think we are two left in 124 series

   Got an e-mail from my atterney. Says: " It is not uncomon for the general information officers to not be able to acess
   the FP info. The current processing time is anywhere up to 18months. i am sure you are aware that the INS processing
   is not always consistent and therefore it is possible for more recently filed case to have been approved, and our office
   has indeed received some approvals within 6 months but this is not the norm. The vast majority of cases do in fact get
   processed in the order received.

   That is guys, go figure.

FYI: WAC 01-108-xxxxx

Called last friday, FP was finally locatable using wac# - a big step to me. FP was taken once in March and once in July(7/17) and the IIO said they received it on 7/18/01, so I guess the first set of FP never get there? Unfortunately, case is still not assigned yet. Will call again this Friday. Good luck to all of us!!

CSC INQUIRY PROCEDURES FOR SPECIFIC TYPES OF PROBLEMS

A. Problem: Matters Pending Beyond Normal Processing Times

Before using the AILA CSC Liaison Inquiry System for matters that are pending beyond normal processing times, the CSC requires that you complete each of the steps that follow. You cannot begin this process -- i.e., send your first fax to INS--until 30 days have passed from the date on the JIT Report listing your case number.

1. Call INS Direct (auto phone inquiry) at (949) 831-8427 and make sure that your matter is still pending.

2. Use a CSC inquiry form and fax it to the appropriate product line and allow 15 days for a reply.

Division I (I-140 & related): (949) 389-3055

Division III (I-130 & related): (949) 389-3482

Division IV (I-485/N-400 & related): (949) 389-3484

Legalization: (949) 389-3483

3. Call INS Direct (auto phone inquiry) at (949) 831-8427 and make sure that your matter is still pending.

4. If no reply after 15 days, fax a second request to the Assistant Center Director for the appropriate Product Line. ACD Divs. I & II (949) 389-3486 ACD Div. III (949) 389-3219 ACD Div. IV (949) 389-3192

5. Call INS Direct (auto phone inquiry) at (949) 831-8427 and make sure that your matter is still pending.

6. If still no reply after 10 days, fax third inquiry to the Service Center Director at (949) 643-1538 and wait three days for a response. Do not fax to all three numbers at the same time, as it will tie up their resources.

7. If you still have not received a reply and INSDirect still indicates that your matter is pending, you have a choice of calling the Center Director’s office at (949) 389 3007 OR using the AILA CSC Liaison Inquiry System by faxing the CSC Inquiry form and Problem Case Inquiry Sheet to the attention of Liaison at (202) 371-9449. YOU CANNOT DO BOTH – ONCE THE CSC’s FRONT OFFICE IS INVOLVED, THE PRODUCT LINE ACD NO LONGER HAS ACCESS TO THE FILE. THE CSC SYSTEM DEALS WITH THE PRODUCT LINE ACD.

B. Problem: INS Error on Receipt or Approval Notice

1. First, check the documents that were filed to make sure that the error is INS’ and not yours. If the error was in the submission, it can be corrected only through re-filing, with fee (the $500 fee on an H-1B would not be necessary again, but the I-129W must be completed to show that the fee is not required). If the error was INS’, the following procedures can be followed.

2. If you find an error on a receipt, prepare the “CSC Request for Correction” sheet and fax it to the CSC Records Support section at (949) 389- 3493. To the extent possible, try to spot errors at the receipt stage—that’s when they stand the best chance for timely resolution.

3. If the error is on the approval notice, prepare the “CSC Request for Correction sheet and fax it to the applicable Division fax number.

4. If you have not received a response within 15 days, you can seek liaison assistance by faxing a copy of the request to the AILA national office at (202) 371-9449. There is no need to pursue additional tiers of inquiry.

C. Problem: Pending Adjustment of Status Case with Fingerprints Expiring in 90 Days.

Go directly to liaison with these. Fax the names, WAC numbers and dates the fingerprints are expected to expire to (202) 371-9449, attn: Liaison.

D. Other Types of Problems

If you have a bizarre denial or request for evidence, or some other issue that you believe should be addressed by the liaison committee, please send it to the AILA National Office Liaison Department at (202) 371-9449. It will be looked at by the entire CSC liaison committee in its regular meetings and, if needed, will be brought to the CSC leadership as a quality control or training problem. IN THE MEANTIME, YOU WILL NEED TO FOLLOW THE REGULATIONS AND EITHER APPEAL A DENIAL OR RESPOND TO AN RFE. IF YOU FEEL THAT THE RFE IS TOO BURDENSOME, USE YOUR LAWYER SKILLS AND JUDGMENT TO SUPPLY A REASONABLE RESPONSE.

You guys with RD in 2001 are getting impatient, think about guys like me who are stuck with RD in 99 and 00 and are still waiting either
because of RFE or without RFE.
I think INS does not follow any process, I cannot believe how
they can keep 3 to 4 year old cases pending and approve new cases of
00 and 01.
