When to file I-9?

My 6 years H1 visa is expiring today. Have got ead. So I guess from tmw i'll be using ead to work in US. Also I will be changing employer next month using ac21.

In this case when should I file I-9?

1. From tmw with current company?
2. From next month with new employer?
3. Should it be filed immediately or it can be filed after 2-3 months?
4. Any issues if filed late?

Any inputs will help me.

You should file I-9 tomorrow since your H1 expires today. Volunteer to do so if your HR representative forgets.

When you change jobs, you should file I-9 on the first day at new job. HR representative there will ask you for it. The law requires all employers to have new employees file I-9 within 3 days of hiring.

Late filing is a problem for employers. But you should try to file it
within the stipulated time.

What is I-9? If I was laid off, and changed to another job, do I need to fill out I-9? If I have not notified INS yet, for almost two months, what will it happen? What is the best thing to do?

Would you explaine more about the problem for the new employer?

You mention "The law requires all employers to have new employees file I-9 within 3 days of hiring." is it right?

I-9 is the "Employment Eligibility Verification Form" that all employees fill out to establish their identity and proof of work authorization. All employees whether US citizen or not have to fill out I-9. It is the law. When you file I-9, you show documents that establish your identity like foreign passport, drivers license, etc and also documents that show you have work authorization (your H1 approval notice, EAD, green card, US passport, etc.)

A new I-9 is required for every new job. A new I-9 is also required if work authorization changes (for example renewed H1, H1 to green card, H1 to EAD, etc.) The law requires I-9 to be filed within 3 business days of employee's first day of employment. I-9 is primarily employer's responsibility and employers can be fined for not complying. BCIS has the right to audit employers to verify I-9 compliance.
