When should i send application?

I received a ticket from NYC MTA police on 05/13/2004 for fare evasion. I will be eligible to send application on 3/20/2009. I was planning on sending my application on 03/23/2009. Someone told me that I should wait after 5/13/2009 to send the application because there's a chance I could be denied since I mailed the application before the 5 year mark after I received the ticket... Any suggestions?

The fine for fare evasion was about $100 in 2008...so might be less than that in 2004.
As long as you paid the ticket given to you by MTA police, you should be fine.

thanks for response... i have proof of payment... fine was only $60...
i will mail out the application on 3/23/2009...
 
I think the application does not specify to list violations only for 5 years. If you choose to list the violations you should list all.

I was asking because I'm in NYC and CUNY, City University of New York, offers free immigration services and a step by step guide on filling out the application... Below is the link and page 3 is in regards to my violation with Transit... This link has very detailed information:
