EB2,I485 RD 11/00, ND 12/00, AP 2/10/01 FP 2/14/01 (the appointment date is 4/14/2001, I did it early at San Jose office), FBI said it is cleared. Got interim EAD 2/21/01.
My wife got a job offer and the company applied for her h1 3 months ago, she plan to go to work next week using EAD card.
Now the problem rises when we laied off some coworkers last week, and there will be company wide H1 holders meeting next month.
My questions:
1. if I lost my job after we used EAD, can I file for another H1 without leaving the country
2. does the senario change if we don\'t use our EAD, in that case am I am still in H1 category, so easy for H1 transfer?
3. when my wife\'s h1 finally got approved, can she switch to H1 status?
4. when I am safe from layoff? after passport stamped or actually got the card?
