When is it Out of Status??

Hi all,

What happens when a person, who is on H1-B, has filed GC application through a US citizen spouse, but loses her/his job?

Does the H1-B spouse lose his status? Any ideas?

You lose your H-1B status, but you're still in legal status (AOS pending).
If you have EAD you can get any other job.
Be careful that, being your H-1B canceled, you can't leave the country until you receive your GC (or I-551 stamp).
Unless you obtain AP, of course.
