When does TSC act on pending 485 application? Based on PD or 485 ND ?

I just got my I-140 approved. My PD is 10/15/2001. 485 RD is 07/19/2006. Which is the order that TSC will consider my 485 application? Based on PD or 485 ND ?

If it is based on PD, will TSC frequently check for I-140 approved current applications to act upon ?

Just trying to see if I am atleast lucky here (after waiting for labor to approve for 4.5 yrs) :o
 
Based on PD. It means India EB2 will retrogress to 2001 soon, because your's is the oldest PD.

Your PD is current. If there are no "name check" or "backgroud check" issues, your application will be approved fairly soon.

These days PDs matter the most. Processing times only come into play when the category is current.

I will exhort you to call / contact TSC through any available means so that somebody gets to cast an eye over your application. You don't want to endure further wait times arising out of possible retrogression which is well on the anvil.
 
When does TSC do "name check" or "backgroud check" ? I gave my FP 2 months back. Can I call someplace to get a status on those checks. I already received EAD and AD documents.

BTW, is the EB2 date also retrogressing? Last i heard was Jan 2003.

poongunranar : Can you please give me some avenues to contact TSC? Would it be a good idea to ask my lawyer to do that or can i directly contact the TSC ?

  1. Start by calling 1-800 and by adopting a convoluted trick that PrinceOfJungle had elucidated (please check in this forum or may be others can help you on this one) to reach somebody at TSC.
  2. Contact your Congress-Person / Senator and apply the pressure.

If your PD is current, that only means that your case is "eligible" for processing. However, there is a backlog of cases, which is where RD/ND kicks in. Officially (https://egov.immigration.gov/cris/jsps/ptimes.jsp) TSC is now processing I-485s received on 4/11/2006. So you might still have a couple of months to go.

However, TSC is by far faster than NSC, and it's been known to often adjudicate cases much sooner than their processing dates suggest. So keep your fingers crossed and hang in there!
