I was arrested for simple DUI and convicted on 06/2014. Paid fines and got 3 years probation which ended on 06/2017. Question is when does the count for GMC starts? is it 06/14 or 06/17?

After completing all probation best to wait from that time period to prove GMC. Good luck.

How can GMC be from the time of arrest? You have to show USCIS that there is a period of time since the incident that you have stayed out of any trouble. If someone is in jail how can they show they have good GMC? It is when they are released then USCIS would be interested in seeing their character to evaluate whether they are a repeat offender etc. OP if I were you just to be on the safe side I would go with the 6/17 date.

At which point did the OP mention anything about being in Jail?

OP would need to show proof that he/she completed said probation.

Its one thing to give an opinion, but don't tell me Mines is wrong without even checking yours.

Like I said GMC starts from the time of Arrest. Would I advise the OP to wait a little longer yes. But my answer stands.

Oh and if USCIS would sit there to evaluate "see into the future according to your reasoning" if someone is a Repeat offender. They might as well throw out the rules in which they implemented and just flat out say. If you've ever been arrested . Simply don't waste your time and apply. Smh

I never said anything that your opinion is wrong but OP was looking for sound advice. I have heard from a few lawyers that good moral character starts after the completion of any court mandated punishment, confinement, probation etc. USCIS would most likely deny the case if someone was still on probation while applying for citizenship. They want to see a period of time where your record is clean to see if you have reformed. I have spoken to three lawyers who told me the exact thing.

OP if you are still there prove to USCIS that you're worthy of citizenship by waiting a few more years. It will most likely save you in filing fees for the future. Also, get a consultation with a good immigration attorney who can advise you well on how to proceed. Good luck.

Yes. thank you . I consulted with two lawyers. They said to apply after five years of probation end date. This is so absurd.
