I am on F-1 Student status. My I-94 is valid until D/S (Duration of Study). I have graduated from my University in Dec. 2003 and applied for OPT which started on Feb 09, 2004 and expires on Feb 08, 2005. But my current I-20 expires on Aug 31, 2004.
I got a job on Feb 16, 2004 and Now I have applied for H1-b through my organization (which is a non-profit) with regular processing. Processing is underway and I have not received receipt of application so far.
Yesterday, I have received an e-mail from my school telling me that I need to get an I-20 extension, as I am still on F-1 Status and my I-20 expires on Aug 31, 2004.
My question is, since my OPT is still valid, DO I need to get I-20 extension ?
How D/S(Duration of Study) is defined ? Is it expiration of I-20 or expiration of OPT, if one has got one ? If it is I-20 expiration then I will be in trouble.
If I get I-20 extension, will have any problem with my H1-b Processing ?? as immigration people may assume that, I am simultaneously trying to apply for H1-b and seeking a student status extension.
But if D/S expires when I-20 expires, I will be in serious trouble after Aug 31, 2004 as I will become a illegal immigrant.
I request somebody to answer my query ASAP, so that I can request for I-20 extension in time.
